Component 3: Piloting agreements on ABS


Activities:

  1. Develop guidance manual on BD Act and the Rules relevant to ABS
  2. Develop sector specific guidelines on ABS issues
  3. Develop implementation options for benefit sharing at different levels
  4. Negotiate and finalize agreements
  5. Establish biodiversity funds along with options for using the funds
Outputs:
1)
A Guidance Manual on the legal aspects of the BD Act, 2002 was prepared for the benefit of PMU and SPU. The guidance manual provides legal provisions of the BD Act in an easily understandable language.
2 )
An explanatory note on the ABS provisions of the BD Act (Sections 3, 4,5,6,7 and 40) has been prepared in an easily understandable and comprehensible language to cover all sections of the public and Government Departments.

To initiate the process of piloting ABS agreements, a review has been conducted and corrections have been suggested to the model benefit Sharing agreements of the NBA.
4 )
Totally 5 agreements were reviewed and suggestion for changes were made in Forms I, II, III and IV and also 37 ABS agreements signed in the project implementing states were identified and the flow of the biological resources is monitored.
5 )
A free-flow of application processing system is in place at NBA for processing the ABS related applications.
6 )
A review has been conducted and corrections have been suggested to the model benefit Sharing agreements of the NBA.
7 )
Economically viable bio-resources was identified, listed in the project implementing states with the help of the BMC Members.
8 )
Linkages have been created between the providers and traders of the bio-resources.
9 )
Economicaly potential bio resources of the project states were identified and the process is initiated.
